TERMS AND CONDITIONS OF WWW.RSTORED.LT 

These terms and conditions for buying and selling in the online store www.rstored.lt (hereinafter referred to as the Rules) are binding and inseparable from the purchase and sale agreement concluded between the electronic store www.rstored.lt (hereinafter referred to as the Seller) and the Seller's client (hereinafter referred to as Buyer) part, which introduces the Buyer to the conditions of purchase and sale of goods in the electronic store and establishes the rights and obligations of the Seller and the Buyer related to the purchase and sale of goods in the electronic store.

I GENERAL PROVISIONS

1. The following persons have the right to use the services of the electronic store:

1.1.able-bodied natural persons, at least 18 years of age;
1.2. minors between the ages of fourteen and eighteen, only with the consent of parents, adoptive parents or guardians;
1.3. legal entities;
2. The personal data provided by the buyer (name, surname, address, telephone number, e-mail address) when registering in the online store are stored and processed in accordance with the 2003 January 23 According to the Law on Legal Protection of Personal Data of the Republic of Lithuania no. IX-1296 and the privacy policy provided by the Seller.
3. The prices of goods and services specified in the product catalogs of the electronic store are valid only when purchasing these goods and services in the electronic store. The prices of goods in the online store are indicated including VAT. The cost of delivery is not included in the price of the product or service and is indicated separately when the order is placed. The price of the delivery of the goods is clearly indicated before the confirmation of the order and is distinguished in a separate line in the confirmation of the order. Mobile phones sold in the electronic store are subject to a special taxation scheme, provided for in Articles 106 - 110 of the Value Added Tax Law of the Republic of Lithuania.
4. The purchase and sale agreement between the Buyer and the Seller is considered to be concluded when the Buyer, having created a basket of goods in the online store, specified the delivery address and familiarized himself with these Rules (by pressing the button "I read and agree with the Rules"), pays for the goods in the basket and the delivery service in the electronic store specified amount.
5. The Seller informs you about the conclusion of the purchase-sale contract by sending a notification to the e-mail address you specified. postal address.

II CUSTOMER RIGHTS AND OBLIGATIONS

6. The buyer has the right to:
6.1. choose and order any of the products in the catalogs of the electronic store;
6.2. receive the purchased goods in the prescribed manner;
6.3. refuse to receive commercial and other offers sent by the Seller;
6.4. replace or return purchased goods in accordance with the procedure established by these Rules and the laws of the Republic of Lithuania;
7. The buyer undertakes:
7.1. provide complete and correct data in the online store registration form. If your contact details change, update them immediately;
7.2. pay for the goods and accept them in accordance with the procedure established by these Rules;
7.3. not to transfer your online store login data to third parties;
7.4. in case of loss of login data, immediately inform the Seller by e-mail [email protected]. The seller is not responsible for the actions of third parties after using the Buyer's login data until the moment of notification and the opportunity for the e-store administrator to change the Buyer's login data. In this case, the Seller has the right to consider that the actions in the online store were performed by the Customer.
7.5. to fulfill their obligations, to comply with these Rules, the Privacy Policy and other conditions clearly indicated in the online store, not to violate the laws of the Republic of Lithuania.
8. The Seller is not responsible for the actions of third parties when such persons, using the Buyer's banking system, submit orders using the services of the electronic store.

III SELLER'S RIGHTS AND OBLIGATIONS

9. The seller has the right to:
9.1. change, suspend or terminate the operation of certain functions of the electronic store or part of them, as well as change the layout of the elements in the electronic store;
9.2. suspend or terminate the activities of the Seller. In this case, all accepted and paid Buyers' orders are completed, and new orders are no longer accepted;
9.3. change the scope or method of service provision. Stop, terminate the provision of services or part of them, charge for services or part of them;
9.4. suspend or terminate the Buyer's registration and use of the e-store services if false, inaccurate, misleading or incomplete requested data is provided, or if there is reason to believe that the Buyer is engaged in illegal activities or otherwise tries to harm the work or stable operation of the e-store.
10. The seller undertakes:
10.1. enable the Buyer to use the services provided by the electronic store;
10.2. deliver the ordered goods to the Buyer within the time limit provided for in the Rules;
10.3. in the event of unforeseen circumstances, being unable to deliver the ordered product to the Buyer, offer the Buyer to purchase a similar product within a reasonable period of time. If the Buyer refuses, return the paid money within 10 (ten) calendar days to the Buyer's account from which the ordered goods were paid;
10.4. respect the privacy of the Buyer. Personal data shall be processed only in accordance with the Rules, Privacy Policy and legal acts of the Republic of Lithuania.

IV DELIVERY OF GOODS

11. When ordering goods, the buyer must provide the following information:
11.1. Buyer's name, if the order is placed by a natural person. The name of the buyer's legal entity, if the order is placed by a legal entity;
11.2. Contact details of phone number, e-mail address;
11.3. The exact address to which the goods must be delivered;
12. Orders are delivered by the methods and terms specified in the online store.

13. The delivery service is free of charge.
14. The goods are delivered on the territory of Lithuania.
15. The shipment is prepared and sent when the Buyer pays for the order in the online store. Payment can be made using electronic banking services of Swedbank, SEB, Luminor, Citadele and Šiaulių bankas, as well as Visa and Mastercard payment cards. Settlements are possible in euro currency. Payments are processed using the makecommerce.lt payment platform.
16. The Seller undertakes to deliver the goods to the Buyer in accordance with the terms specified in the product descriptions. In case of unforeseen circumstances, the Seller undertakes to contact the Buyer and coordinate the delivery date of the goods and other delivery-related issues.
17. The Seller is released from responsibility for violations of the terms of delivery of goods, if the goods are not delivered to the Buyer or are delivered late due to the Buyer's fault or due to Force Majeure circumstances.
18. During the delivery of the package, the Buyer must check the condition of the package together with our representative (Courier). After the buyer signs the delivery of the shipment - the document marking the acceptance, it is considered that the shipment has been delivered in a suitable condition. If the buyer notices that the package of the shipment is damaged (crumpled, wet, or otherwise externally damaged) or that the delivered product is of an inappropriate package, quantity, or assortment, he must note this in the acceptance-handover document and write a free-form shipment violation deed.

V GOODS QUALITY AND WARRANTY

19. The general characteristics of each purchased item are indicated in the description of that item. Specifications and descriptions provided may differ from actual product specifications and descriptions.

21. The warranty starts from the day of sale of the product to the Buyer.
22. The seller, with the help of third parties, provides warranty service for the goods.

VI RETURNS AND EXCHANGES

23. Defects in goods are eliminated, defective goods are replaced and returned in accordance with the Civil Code of the Republic of Lithuania and the 2001 Decree of the Minister of Economy of the Republic of Lithuania. June 29 by the provisions of the order "On approval of the rules for returning and exchanging items" (Retail Trade Rules, July 22, 2014, version No. 738).
24. The buyer has the right to withdraw from the contract within fourteen days, without giving a reason and incurring costs other than those specified in Article 6.22810 of the Civil Code of the Republic of Lithuania, except for the exceptions provided for in Article 6.22810, Part 2 of the Civil Code of the Republic of Lithuania.
25. The contract withdrawal period expires after 14 (fourteen) calendar days, counting from the day the product was delivered to the Buyer.
26. In order to return the product, the buyer must inform the Seller about it by e-mail. by mail [email protected]. The Seller sends a notification about the contract cancellation confirmation to the e-mail specified by the Buyer. by post After canceling the contract, the buyer must coordinate the method of returning the goods and other related issues with the seller by e-mail within 3 working days.
27. If the Buyer exercises the right to withdraw from the contract within 14 (fourteen) calendar days, the Buyer bears the direct costs related to the return of the goods.
28. Together with the returned product(s), the Distance Agreement cancellation form (original) and the document confirming the purchase of the goods must be returned.
29. The returned item must be in the original, clean, neat packaging provided by the Seller, unused, with all its original accessories. If the item is not fully assembled, it is not accepted for return.
30. If the Buyer returns the product(s) without complying with the provisions of this section, the Seller has the right not to accept them, informing the Buyer about this.
31. The Seller has the right not to return the money paid to the Buyer until the goods are returned to the Seller.
32. If the Buyer withdraws from the contract, the Seller returns the money paid for the goods to the Buyer's specified account within 10 (ten) calendar days from the day of return of the goods.

VII RESPONSIBILITY

33. The buyer is responsible for the correctness of the data provided in the product order form and in the registration account. If inaccurate or incomplete data is provided in the registration account and the order form, the Seller is not responsible for the consequences arising from this reason.
34. None of the parties is responsible for failure to fulfill its obligations due to Force Majeure circumstances as these circumstances are understood in accordance with the Civil Code of the Republic of Lithuania. A party that is unable to fulfill its obligations due to Force Majeure circumstances must as soon as possible, but no later than within 24 hours. notify the other party of these circumstances. In such a case, the performance of the corresponding obligation is postponed until the termination of such Force Majeure circumstances.

VIII FINAL PROVISIONS

35. The seller reserves the right to suspend, at its own discretion, supplement, change these Rules and other documents related to the Rules, informing about this in the online store. Additions or changes to the rules take effect from the date of their publication, i.e. i.e. from the day they are placed in the electronic store system.
36. If the Buyer does not agree with the new version of the Rules, partial changes or additions, the Buyer has the right to refuse them, provided that the Buyer loses the right to use the services of the electronic store.
37. If the Buyer continues to use the services of the electronic store after the amendment of the Rules, it is considered that the Buyer agrees with the new version of the Rules.
38. All disagreements regarding the implementation of these Rules shall be resolved through negotiations. If it is not possible to reach an agreement, disagreements are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
39. The law of the Republic of Lithuania applies to these rules.
